Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES TO THESE OFFICIAL RULES.

1. SPONSOR: Oceania Cruises Ltd., 7665 Corporate Center Drive, Miami, FL 33126 (“Sponsor” or “Oceania”).
2. ADMINISTRATOR: Brandmovers, Inc., 1519 Carroll Drive, Atlanta, GA 30318 (“Administrator”).
3. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. The Oceania Cruises “2025 Foody Sweepstakes” (“Sweepstakes”) is open to legal residents of the 50 United States, District of Columbia and Canada who are at the age of majority or older in the state/province/territory as of the date of entry (the “Entrant”). Employees, officers and directors of either Administrator and Sponsor and their respective parent, subsidiaries and affiliates , together with their distributors, vendors, advertising/promotion agencies, and any others engaged in the development, production, execution or distribution of this Sweepstakes including, but not limited to, the entities supplying the Prizes herein (collectively, the “Giveaway Entities”) as well as their immediate family members (spouses, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of such employees, officers and directors are not eligible to participate. All federal, state, and local laws and regulations apply. Sweepstakes is void wherever prohibited or restricted by law.
4. SWEEPSTAKES PERIOD: The Sweepstakes begins on February 15, 2025 at 12:00:00 AM Eastern Time (“ET”) and ends on March 31, 2025 at 11:59:59 PM ET (“Sweepstakes Period”). The Administrator’s database clock is the official timekeeper for this Sweepstakes.
5. HOW TO ENTER: To enter, find and scan the Sweepstakes QR Code available in a direct mail piece that you have received, which will take you to the Sweepstakes online entry page located at www.oceaniascruisesgiveaway.com (“Website”) where you must register and submit all requested information. Alternately, if you are on Facebook and see an advertisement for the Sweepstakes, you may enter directly from the ad unit without having to visit the Website. In either event, and upon completing all tasks, you will receive one (1) entry into the Sweepstakes random drawing. Limit one (1) entry per person during the entire Sweepstakes Period.
   
   All entries must be received by the end of the Sweepstakes Period to be eligible for the random drawing. Sponsor is not responsible for any technical glitches that may interfere with submitting an entry.
6. RANDOM DRAWING AND WINNER NOTIFICATION: On or about April 3, 2025, Administrator will randomly select one (1) Grand Prize winner ('Grand Prize Winner) from among all eligible Entries received during the entire Sweepstakes Period. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. The Grand Prize Winner will receive a winner verification email by Administrator on or about the day of the random drawing. The winner must respond to the winner notification email within 48 hours of first attempted notification, or will forfeit their right to the Prize and the Prize may then be awarded to an alternate winner, at Sponsor’s sole discretion, time permitting. Winner will then be required to complete and return an Affidavit of Eligibility and/or a Liability and Publicity Release (where legal) to Sponsor or Administrator within 7 days of receipt of such Releases, or will forfeit their right to the Prize (at Sponsor’s sole discretion). Sponsor may provide the Winner with an IRS Form 1099 reflecting the actual final retail value of the Prize, where applicable, or such other governmental tax forms that may be necessary, as determined in the sole discretion of Sponsor. Upon Administrator’s or Sponsor’s receipt of any required Releases, Administrator or Sponsor will email the Prize to the Winner. Sponsor or Administrator will work directly with the Grand Prize Winner to arrange how they will obtain the Grand Prize. Neither Administrator nor Sponsor are responsible for undeliverable, unanswered emails or other technical glitches related to the emailing of any Prize or winner notification. CANADIAN RESIDENTS ONLY: If the potential Grand Prize winner is a resident of Canada the potential winner must first correctly answer a mathematical question/equation, unassisted, as a condition of being eligible to receive the Grand Prize. In the event you answer the question incorrectly, you will forfeit your right to the Grand Prize and an alternate may be selected, at Sponsor’s sole discretion, time permitting.
7. PRIZES & APPROXIMATE RETAIL VALUE (“ARV”): One (1) Grand Prize - A link to a culinary eBrochure hosted by Oceania and an Oceania cruise for two(2) for the Grand Prize Winner and Grand Prize Winner’s guest based on double occupancy in a level B4 stateroom. Trip includes a $500 airfare voucher, which may be used towards air travel to/from the cruise port of embarkation and a cruise certificate (“Certificate”) for two people for any Oceania cruise that is up to 10 days in length based on availability with standard cruise inclusions. Cruise certificate must be booked by December 31, 2025 or will be forfeited and is subject to availability as determined by Sponsor, and is non transferable. Blackout dates may apply. Prize is cruise-only and does not include transfers, pre/post land packages, beverage packages, shore excursions, gratuities or any government fees or taxes.
   
   Total ARV of the prize being awarded: $7,500 USD.
8. GRAND PRIZE RULES AND RESTRICTIONS: Grand Prize Winner and guest must travel on the same itinerary. Changes in accommodation type may be available upon request at an additional cost. Additional guest accommodations must be purchased at available cruise line rates. Guests under the age of 18 years must be accompanied by a parent, grandparent, or a guardian 25 years or older in the same stateroom. The Simply More promotion that includes free shore excursions and free beverage package, governmental fees and taxes is specifically EXCLUDED from this Prize. Certificate includes accommodations, regular dining and non-alcoholic beverage portion of the cruise fare only. Grand Prize Winner is responsible for all other expenses, including without limitation: airport transfers, ground transport, taxes, government imposed security fees, port fees and taxes, miscellaneous personal and incidental expenses, alcoholic beverages, spa services, gratuities, shore excursions, administrative costs, and agency fees. Exact costs are calculated and due at the time of booking. Government/port taxes and fees are additional for all guests and are payable at the time of booking confirmation. Fuel supplement charges may be required on some bookings.
   
   In the event Grand Prize Winner resides within a 300-mile radius of the port of call, winner will not receive airfare voucher as part of the prize and will receive ground transportation in lieu of airfare, and any difference between the stated ARV and actual ARV will not be awarded.
   
   Prizes are not transferable and may not be redeemed for cash value. All federal, state and local taxes on prize are the sole responsibility of the winners. Prizes consist of only the items specifically listed as the prize. No cash redemptions. No substitutions of prize, except as provided herein. Sponsor reserves the right to substitute Prize for one of equal or greater value for any reason.
9. ENTRY CONDITIONS AND RELEASES: By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sweepstakes Entities from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sweepstakes Entities from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant's participation in the Sweepstakes and/or entrant's acceptance, use or misuse of prize. Winners acknowledge and agree that as a part of entering their name on an entry form that they consent to their name being disclosed by Sponsor and/or Administrator for publicity purposes and the winners’ list request.
10. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the Winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other Sweepstakes or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. LIMITATIONS OF LIABILITY: The Sweepstakes Entities as set forth above are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another Entry in the Sweepstakes, provided that if it is not possible to award another Entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the Prizes offered herein. Entrant further agrees and acknowledges that Sponsor reserves the right to forfeit or award any unclaimed or leftover Prize at its sole discretion.
12. DISPUTES/GOVERNING LAW: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, other than those concerning the administration of the Sweepstakes or the determination of Winners or for any disputes arising from the loss or injury from the participation in a Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Official Rules (except for any disputes arising from the loss or injury from the use of Prizes) shall be submitted to final, binding arbitration conducted in the State of Florida under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Florida state or federal court judge with experience in entertainment matters who shall follow Florida law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in the state of Florida, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of the state of Florida. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in the state of Florida; (iii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
13. PRIVACY: Entrants agree that their personal information may collected and used by Sponsor in accordance with Sponsor’s Privacy Policy at https://www.oceaniacruises.com/legal/privacy-policy. By opting in to receive marketing communications, entrants agree to receive special offers and newsletters via electronic mail from, or on behalf of, Sponsor for online marketing purposes, including but not limited to future offers and promotions.
14. WINNER'S LIST/OFFICIAL RULES For the list of Winners’ names (available after June10, 2024), send a hand-printed, self-addressed, stamped envelope to: Winners List, Oceania Cruises 2025 Foody Sweepstakes Winners, Brandmovers, Inc., 1519 Carroll Drive, Atlanta, GA 30318.
